Welcome to NEAST ("App"), a mobile application owned and operated by NEAST SDN BHD ("NEAST", "we", "our", or "us"), a company incorporated in Malaysia.
By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, please discontinue the use of the App immediately.
1. Eligibility
You must be at least 18 years old or have the permission of your parent or legal guardian to use the App.
By using the App, you represent that you have the legal capacity to enter into these Terms under the laws of Malaysia.

4. User Content

By uploading content, you grant NEAST SDN BHD a non-exclusive, worldwide, royalty-free licence to store, process, display and use such content solely for operating, maintaining and improving the App and providing the services requested by you.
You are solely responsible for ensuring your uploaded content:
- Does not infringe intellectual property rights.
- Is lawful.
- Is not defamatory, obscene or offensive.
- Does not violate the rights of any third party.
We reserve the right to remove any content that violates these Terms or applicable laws.
5. Intellectual Property
All copyrights, trademarks, logos, software, graphics, designs, databases and other intellectual property relating to the App remain the exclusive property of NEAST SDN BHD or its licensors.
Nothing in these Terms grants you ownership of any intellectual property rights.
6. Third-Party Services
The App may contain links to or integrate with third-party services, payment providers or external websites.
NEAST SDN BHD is not responsible for:
- The availability of third-party services.
- Their privacy practices.
- Their terms and conditions.
- Any products or services offered by third parties.
Your use of third-party services is subject to their own terms.
7. Fees and Payments
Certain services or features may require payment.
Where applicable:
- Prices will be displayed before payment.
- Payments are processed through authorised payment providers.
- Fees paid are generally non-refundable unless otherwise required by law or expressly stated.

Continued use of the App after updates constitutes acceptance of the updated version.

To the fullest extent permitted under Malaysian law, NEAST SDN BHD makes no warranties, express or implied, including but not limited to:

- Continuous or error-free operation.
Users assume all risks associated with using the App.
11. Limitation of Liability
To the maximum extent permitted by applicable law, NEAST SDN BHD shall not be liable for any:
- Indirect damages.
- Incidental damages.
- Consequential damages.
- Special damages.
- Loss of profits.
- Loss of business.
- Loss of data.
- Loss of goodwill.
Our total liability arising from your use of the App shall not exceed the amount paid by you (if any) for the services within the twelve (12) months preceding the claim.
12. Indemnity
You agree to indemnify and hold harmless NEAST SDN BHD, its directors, employees and affiliates against any claims, losses, liabilities, damages or expenses arising from:
- Your misuse of the App.
- Your breach of these Terms.
- Your violation of any law or third-party rights.
13. Suspension and Termination
We may suspend, restrict or terminate your access to the App at our sole discretion if:
- You violate these Terms.
- We suspect fraudulent or illegal activities.
- Continued access may harm the App or other users.
Termination does not affect any rights or obligations accrued before termination.

Your use of the App is also governed by our Privacy Policy.
By using the App, you consent to the collection, processing and use of your information in accordance with the Privacy Policy.

NEAST SDN BHD reserves the right to amend these Terms at any time.
Updated Terms will become effective once published within the App or on our official website.
Your continued use of the App after the changes constitutes acceptance of the revised Terms.
16. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Malaysia.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
